This Cookie Notice is part of Ocular Therapeutix Inc.’s Global Privacy Notice and describes how Ocular and its affiliates (“Ocular,” “we,” “us,” orour”) use technical activity and usage technologies (as defined below) on our websites and other online services we operate and that link to this Cookie Notice (collectively, the “Site”).

This Cookie Notice describes:

  • what are technical activity and usage technologies and what they do (defined below as Usage Technologies);

What are Usage Technologies and What Information if Collected

We periodically evaluate our use of Usage Technologies and will update this Cookie Notice as our practices change. We will indicate the effective date at the top of this notice.

Our Use of Usage Technologies

We and certain third parties use technical activity and usage technologies, known as cookies, web beacons (or tags, pixels, or clear GIFs), and other similar technologies (collectively, “Usage Technologies”). Below is a chart that lists our and third-party Usage Technologies we use.

We use these Usage Technologies to collect certain identifying and non-identifying information about visitors to and devices used by visitors on our Sites; interactions with our emails, advertisements, and social media plugins; to honor navigation and content preferences; to establish and monitor network connections; to maintain and monitor the proper functioning of our Sites; to monitor and manage security and performance issues; to administer authenticated sections of the Site; to enable certain special features and functionality (including from third parties) on our Sites; and to generate usage and activity analytics to better understand and improve the use and performance of our Sites and their features. When Usage Technology we own and control collects information that identifies you directly or indirectly, or where such information is deemed to be Personal Data under applicable law, we will handle that information as described in the relevant Ocular Privacy Notice.

Usage Technologies often store the name of the website and a unique ID associated with the browser or device used to access the Site. This information allows us to retrieve or provide the correct information concerning the visit to our Site, including whether the same device or browser was used and the frequency of visits. These are also used to remember personal navigation or content preferences, to authenticate access and identity, monitor through IP addresses, collect browsing history, and to better under that the use of the Site (such as links clicked and navigation to, within, and from our Site). Each Usage Technology may vary in the way it retrieves information, how it stores it, and the extent of information it provides.

The retention period of Usage Technologies in your device will vary. Our Site uses single-session (transient) and multi-session (persistent) Usage Technologies. Transient Usage Technologies last only as long as the device’s web browser is open, and the information collected is used for technical purposes such as enabling better navigation on our Sites. Once you close your browser, the transient Usage Technology disappears. Persistent Usage Technologies are stored on your device for longer periods and are used for purposes which include tracking the number of unique visitors to our Site and information such as the number of views a page gets, how much time a device or user spends on a page, and other pertinent web statistics. If you wish to disable the use of Usage Technologies or remove them at any time from your device, you can disable or delete them using your browser (consult your browser’s “Help” menu to learn how to delete cookies and other Usage Technologies); however, you must enable certain Usage Technologies to access certain information on our Site.

Web Beacons

We use web beacons to see if someone has used or accessed certain content, to measure the effectiveness of our advertising, and how users interact with the Sites. A web beacon is an often-transparent graphic image, usually no larger than 1 pixel x 1 pixel, that is placed on a website or in an e-mail. We primarily use web beacons to help us understand which areas of our Site are most popular with our visitors, to improve and update the content on our Site, and measure the effectiveness of our marketing, for example, by counting the number of individuals who visit our Site or open an email message or click a link. Although a third-party logs the information coming from our Sites on our behalf, we control how that data may and may not be used. Social Media Plug-Ins

Ocular offers social media plug-ins for third-party social networks (each a “Social Media Company” and collectively, “Social Media Companies”) that include Facebook, X, LinkedIn, YouTube, and Instagram. For example, we have Facebook like and share buttons, a tweet button for X, and embedded videos that offer certain interactive features.  We and the Social Media Company track your interactions with these functions. Integration of the plug-ins allows Social Media Companies to receive information that you have loaded onto our Site. When you visit our Site, the operators of the social media plug-ins place Usage Technologies on your computer that enable them to recognize you on their websites after you have visited our Site, or that enable them to add the information collected from your visit to our Site with your prior activity on those websites. 

We do not control what information is collected by the social media plug-ins or the information practices adopted by those Social Media Companies. This information exchange takes place automatically. To prevent this exchange, you can log out of your social media account(s) before using the Site and/or disable Usage Technologies through your device’s web browser.

Kinds of Usage Technologies We Use

Necessary/Essential

These Usage Technologies are necessary for our Site to function and cannot be turned off without losing functionality. These Usage Technologies are used, for example, for the security of our Site and to administer your preferences. In some instances, we give information from these Usage Technologies to our vendors, including those that provide the essential Usage Technologies we use.

Performance

These Usage Technologies allow us to count unique visits and traffic sources so we can measure and improve our Site. We use this information to understand the section of our Site that are the most and least popular, and how visitors navigate around the website. This information is typically aggregated to provide analytics. We may give or allow collection of information from these Usage Technologies to our vendors who assist us with, for example, website user identification, website consistency, and data analytics.

Functional

These Usage Technologies provide information that enable enhanced functionality and personalization. They may be placed by us or a vendor whose services we have added to our Site. These are usually set in response to actions taken by the user, such as a request for special features, functions, or services on the Site. We may provide information or allow direct collection of information from these Usage Technologies who assist us with, for example, our online applications, webforms, and feedback or survey tools.

Advertising and Marketing

These Usage Technologies may be set on our Site by us or our advertising and marketing partners. They may be provided or collected directly from our vendors through these Usage Technologies, and used, for example, to limit how often you see a particular advertisement or measure the effectiveness of an advertising campaign by determining if you visit our website after viewing our advertisement. They do not store information that directly identifies you, but they may use information that uniquely identifies your browser or device and which may be combined with other information to identify you. Adobe products are used to design our Site and to provide analytics to help us track and study use of it to improve its performance.

Google

We use various Google products, including Google Analytics and Tag Manager, to understand our Site traffic and advertising performance. In addition, we use Google’s reCAPTCHA to protect our Site from spam and invalid traffic. The data collected by Google reCAPTCHA is not used for personalized advertising.

LinkedIn

LinkedIn offers products that we use to get detailed insights about our Site performance and to advertise and understand the effectiveness of our advertising.

YouTube

YouTube Cookies may be used when our Site provides embedded video content to provide this functionality to you.

During your visit to our Sites, the following data may be collected:

  • The pages you call up (i.e., your “click behavior”);
  • Achievement of “goals” (conversions, e.g., newsletter registrations, downloads, purchases);
  • Your user behavior (e.g., clicks, time spend, bounce rates);
  • Your approximate location (region);
  • Your IP address (in abbreviated form);
  • Technical information about your browser and the end device you use (e.g., language settings, screen resolution);
  • Your internet provider; and
  • The referrer URL (the website/advertising medium from which you came to our Site).

On our behalf, the Analytics Providers will use this information to evaluate your use of our Site to compile reports on the activities. The reports provided by the Analytics Providers are used to analyze the performance of our Site.

You can prevent the collection of data generated by Usage Technologies and related to your use of our Site (including your IP address) and the processing of this data by HubSpot by adjusting your cookie tracking settings in your device or browser, including the use of third-party blockers. To prevent such collection by Google Analytics, you can download and install the browser add-on to disable Google Analytics, available here.

It should be noted that the Analytics Providers may use the data described in this section for their own purposes and may link it to other data already maintained by the Analytics Providers.

Your Choices

All visitors to our Site should have access to at least one of the following options to restrict our use of Usage Technologies and related information.

Consent

If we require your consent for Usage Technologies, you will get a notification banner to your browser when visiting our Site. If you close the banner or click on the accept link, we process this action as consent to use of our and our third-party Usage Technologies, and all Usage Technologies for the Site will be placed unless you have separately disabled them using your own browser settings (see “Opting Out Using Your Browser” below). You may change your preferences at any time by using your browser’s private or incognito browsing settings, deleting all cookies from our device, or using one or more of the self-regulatory programs referred to below.  Essential/Necessary Usage Technologies will continue to be placed without your consent.

Using Self-Regulatory Programs

You may opt-out from the marketing use of information collected through certain Usage Technologies through some self-regulatory programs that enable you to control the use of your data from Usage Technologies for marketing purposes. The two most widely used programs are the Digital Advertising Alliance and the Network Advertising Initiative, which help to regulate vendors in the digital advertising space. Through these programs you can opt-out of targeted (or interest-based) advertising, including Usage Technologies, from their member companies.
